What this test checks
Looks for health and safety convictions of the company that followed a death at work.
Most such cases are prosecuted under the Health and Safety at Work etc. Act 1974; the most serious can be brought as corporate manslaughter. Either way, they are the gravest health and safety findings a company can have.
What a fail looks like
The company has been convicted in connection with a fatality.
Harmless explanations
- There is no harmless version of this finding, but its weight depends on how long ago it happened and what the company has done since.
What to do
- Read the case: when it happened, what failed and what the court found.
- Ask for evidence of the changes made since, and consider independent assurance before engaging the company for similar work.
Background: Environmental and social risk.
